BNS 252 - Making an Agreement to Return Stolen Property is Also a Crime

Definition of Section 252 of the Bharatiya Nyaya Sanhita, 2023

Accepting a gift in exchange for helping to recover stolen property, etc.: If any person enters into an agreement with a property owner to recover stolen property, such as not taking action against the thief, demanding money for themselves, etc., then that person will be guilty under Section 252 of the BNS.

Provision of punishment under Section 252 of the Bharatiya Nyaya Sanhita, 2023

Offenses under this section are cognizable and bailable, meaning a direct FIR can be filed by a police officer for this offense, and a complaint can also be filed before a first-class judicial magistrate. The trial of this offense is conducted by a first-class judicial magistrate, and this offense is not compoundable.

Punishment: For the offense under this section, the offender can be punished with imprisonment for two years, or a fine, or both.
